Trump orders temporary dyed-diesel tax relief, subject to Treasury finding

Executive order signed; Treasury eligibility determination and implementing guidance pending

Donald Trump

Trump signed an executive order directing the Treasury secretary to decide within five days whether federal law authorizes temporary relief for highway use of dyed diesel. If Treasury makes the required findings, the order directs it to defer covered excise-tax payments incurred from October 5 through December 31 without interest or penalties. It also directs the IRS to announce temporary relief from specified penalties for selling or using dyed diesel on highways. Reuters reported that Trump presented the measure as expanding access to lower-cost, tax-exempt diesel.

Response / context

The White House says the policy is intended to lower costs for farmers, truckers and workers. The signed text does not itself permanently forgive the tax: relief is conditional on Treasury's legal determination, implementation is limited by applicable law, and the order separately tells Treasury to explore legislation or other avenues to eliminate deferred obligations. Reuters reported diesel prices had recently reached about $6.50 a gallon amid war-related supply disruptions; whether the order will materially reduce retail prices was not yet established.
