Two lawsuits seek to stop taxpayer-funded television ads promoting Trump

Two federal lawsuits filed October 7 seek to stop the Trump administration from using taxpayer money for television advertisements promoting President Donald Trump. The Democratic National Committee's 31-page District of Columbia complaint, case 1:26-cv-03506, alleges violations of statutory restrictions on publicity or propaganda and other spending limits. A separate 41-page Southern District of New York complaint, case 1:26-cv-08882, was filed by Common Cause, Alabama legislative candidate Robert Hunter, SEIU Local 32BJ and its political action committee. The second suit also challenges the $20 million funding shift and advertising contract. These are the plaintiffs' allegations and requests for relief, not judicial findings.

Response / context

Trump has described the advertisements as positive promotion for the United States. The White House has defended them as educational, patriotic public-service announcements and said MAGA Inc. would pay for them going forward; it told Reuters the political committee would not reimburse taxpayers for advertisements already aired. Reuters reported that a source briefed on the matter said the government-funded advertisements would end this week. AP reported that a fifth advertisement began airing Tuesday with a 'Paid for by the U.S. Government' notice and that the two lawsuits represent the first court challenges to the campaign. The DNC complaint claims at least $100,000 in public money was spent after the announced funding shift. The New York plaintiffs allege the administration improperly redirected funds intended for border-security commemorations and seek to invalidate the transfer and contract and recover unspent money. Those figures, alleged statutory violations and requested remedies have not been adjudicated. No ruling or administration court filing responding to either complaint was identified in the reviewed sources.
