PhRMA sues Trump administration over Medicare GLOBE drug-pricing rule

Lawsuit reported; statutory-authority claims disputed; no court ruling identified in the reviewed sources

Donald Trump

Reuters reports that PhRMA, the pharmaceutical industry's trade group, sued the Trump administration October 7 in federal court in Washington over the Medicare GLOBE drug-pricing rule. PhRMA argues that CMS exceeded its authority to test payment models. Pharmaceutical Commerce reports that the group seeks to have the rule declared unlawful and vacated. Those are the plaintiff's claims and requested relief, not judicial findings.

Response / context

CMS's September 30 announcement says GLOBE will test international-price benchmarks for rebates on selected clinician-administered Medicare Part B drugs, aiming to lower costs while preserving care and innovation. In the October 2 final rule, CMS defends its statutory model-testing authority and says the program is limited in scope and duration. The official Federal Register sets November 30, 2026 as the regulation's effective date; voluntary manufacturer data collection starts January 1, 2027, and the performance period starts April 1, 2027. A lawsuit does not itself suspend a rule. The complaint was not independently retrieved in this review; its filing and claims are attributed to the cited reporting. No ruling on this suit is identified in those sources.
