Trump DOJ ends federal registration enforcement for silencers and certain short-barreled firearms

The Trump Justice Department says ATF will no longer enforce National Firearms Act requirements that individuals obtain prior approval or register suppressors, short-barreled rifles, short-barreled shotguns and certain other concealable weapons for which Congress reduced making and transfer taxes to zero. ATF says the policy applies nationwide as an exercise of enforcement discretion, even though the August 5 federal-court injunction that prompted it applies only to the plaintiffs and specified related parties. DOJ also decided not to appeal that ruling.

ATF says the covered items remain firearms under the Gun Control Act: licensed dealers must continue using Form 4473, conducting NICS background checks, keeping records and obeying state and local law. Machine guns and destructive devices remain subject to the full NFA and the $200 tax. Interstate transport of short-barreled rifles and shotguns still requires Form 20 approval, and ATF will continue accepting voluntary NFA registrations where state law or individual circumstances make them necessary. The agency warns that enforcement could resume if Congress restores a tax, the injunction changes or DOJ rescinds the policy; federal law provides no automatic grandfathering for unregistered items. Everytown for Gun Safety criticized the decision as improper selective enforcement, while ATF said a national policy avoids a confusing patchwork. No higher court has affirmed the Texas ruling, and ATF notes that other courts are not bound by it.
