FEC lacks quorum as Trump-linked campaign-finance complaints remain unresolved
Source published: Oct 17, 2026 · 5:00 AM EDT · Event: 2026-10-17
The Federal Election Commission remains without the four-member quorum required to exercise its core statutory powers during the 2026 midterm cycle. The agency's inspector general says the FEC has lacked a quorum since April 30, 2025, and has had only two commissioners from the same party since October 3, 2025. Without a quorum, the commission cannot approve enforcement actions or audits, authorize new investigations or referrals, issue advisory opinions, make rules or initiate litigation. An official third-quarter report counted 307 total enforcement cases, including 157 reports awaiting commission action as of July 24, and listed no civil penalties collected in fiscal 2026.
Response / context
The Washington Post reported that President Trump nominated Ashley Stow and Andrew Woodson, both Republicans, in February 2026, but the Senate had not acted on the nominations by October 17. The Post also reported that Campaign Legal Center complaints against Trump and MAGA Inc. remain unresolved. The center alleges that Trump's repeated statements that he controls the super PAC violate federal restrictions on officeholders directing soft-money spending. Those are the complainant's allegations: the FEC has not issued a finding, opened a newly authorized investigation, charged a violation or ruled on the complaints. A MAGA Inc. spokesperson did not respond to the Post's request for comment; the Ledger identified no separate public response from Trump or the White House to those complaints during this review. Acting FEC Chair Shana Broussard told the Post that some complaints may have to be dismissed once a quorum returns because limitations periods have expired, although corrective steps that do not involve penalties may remain possible. The agency is not entirely inactive: staff can still help filers, review reports, publish data, process new complaints and continue investigations or litigation previously authorized.
