Judge limits DHS voter investigations in nine states
Source published: Oct 22, 2026 · 11:02 AM EDT · Event: 2026-10-21
A federal judge issued a preliminary injunction restricting Department of Homeland Security election-related field operations in California, Connecticut, Georgia, Missouri, Nevada, New York, Pennsylvania, Washington and Wisconsin. The order bars specified operations involving people the government knows, suspects or should reasonably know or suspect are U.S. citizens, and bars operations based wholly on records created through the challenged voter-eligibility matching policy against such people.
Response / context
Judge Araceli Martínez-Olguín found that the California Nurses Association and National Nurses United were likely to succeed on their claim that the initiative intimidated voter-assistance and mobilization activity in violation of Section 11(b) of the Voting Rights Act. She cited flawed source data, acknowledged matching errors and field operations involving armed officers. The administration argued that federal law authorizes investigations of unlawful voting and that its processes seek to exclude citizens. The court expressly said it was not holding that voter-fraud investigations are themselves unlawful; the injunction is limited to the practices and people specified in the order. It is preliminary, not a final judgment, requires a $100 bond and is stayed until October 23 at 5 p.m. EDT to allow an appeal. The Washington Post reported that DHS and DOJ did not immediately comment.
