Grand jury declines DOJ request to indict Cassidy Hutchinson

No indictment returned on DOJ's presented allegations; no acquittal or judicial merits ruling

Donald Trump

A federal grand jury in Washington declined the Justice Department's request to indict former Trump White House aide Cassidy Hutchinson over testimony she gave to the House committee investigating the January 6, 2021, Capitol attack, according to Associated Press, ABC News, CBS News and The Washington Post. CBS and the Post reported that DOJ Civil Rights Division lawyer Neville Hedley told U.S. Magistrate Judge Zia Faruqui that the grand jury had not concurred on the proposed indictment, without naming the target in court; multiple sources identified Hutchinson. No indictment was returned. That disposition is not an acquittal and does not resolve the truth of every disputed statement.

Response / context

ABC reported that prosecutors had sought lying-to-Congress charges, while CBS said it could not determine precisely which portions of Hutchinson's testimony were scrutinized. Hutchinson has maintained that she stands by her testimony. Trump has denied her account, including the secondhand story that he lunged toward the steering wheel of his vehicle on January 6; the driver later disputed that detail. AP reported that Hutchinson's lawyer did not immediately return a request for comment. ABC, CBS and the Post reported no immediate Justice Department response. Those denials, reports and source accounts are not substitutes for inaccessible grand-jury materials.
