Judge rejects DOJ bid to end xAI Clean Air Act suit

EPA intervention granted, federal request to dismiss denied; NAACP's Clean Air Act claims continue with no merits finding against xAI

Elon Musk · Donald Trump

A federal judge allowed the United States, acting for the Environmental Protection Agency, to intervene in the NAACP's Clean Air Act lawsuit against Elon Musk's xAI but rejected the Trump administration's attempt to dismiss the case. Judge Debra Brown ruled that the Clean Air Act gives EPA an unconditional right to intervene but does not authorize the government to terminate another plaintiff's citizen suit simply by joining it.

Response / context

The NAACP and its Mississippi conference allege that xAI and affiliate MZX Tech constructed and operated a gas-fired power plant in Southaven, Mississippi, without required permits. Those are allegations, not findings. The United States argued that EPA's enforcement primacy and Article II allowed it to dismiss the case, while the plaintiffs argued that the statute preserves citizen enforcement unless the government is diligently prosecuting a related action. Brown did not decide whether xAI violated the Clean Air Act. Reuters reported that EPA declined to comment and xAI did not immediately respond to its request for comment.
