Kennedy Center filing identifies withheld Harp and Lutnick texts
Source published: Oct 25, 2026 · 3:42 PM EDT · Event: 2026-10-25
An October 25 filing by Rep. Joyce Beatty's lawyers says a privilege log identifies Kennedy Center communications withheld under claimed presidential communications privilege. The listed records include 19 text messages between Kennedy Center CEO Matthew Floca and Trump executive assistant Natalie Harp, 11 of them on September 15 when the board voted for a third time to close the center, and roughly 180 center-related texts between Floca and Commerce Secretary Howard Lutnick from May 30 through September 15. The filing characterizes Lutnick as Trump's go-between and argues the records bear on whether the board acted independently. Those are the plaintiff's arguments; the messages themselves were not attached and Judge Christopher Cooper had not ordered their production at review time.
Response / context
The defendants' privilege log, as described in the filing, characterizes the Harp messages as reflecting Trump's deliberations and the Lutnick thread as reflecting advice from Trump concerning Kennedy Center operations, renovation, board and management matters. The administration has asserted presidential communications privilege and, according to AP, did not immediately comment on the October 25 filing. Beatty's lawyers dispute the privilege claim and ask for immediate production. AP reports that Cooper previously ordered removal of Trump's name from the building and later required 30 days' notice before major physical changes. Those prior orders do not resolve the new discovery dispute, and the October 25 filing is not a ruling that the communications must be produced or that the plaintiff's characterization is correct.
