- The case
- The Justice Department lists his conviction as receiving and possessing an unregistered firearm, unlawful possession and transfer of a machine gun, and three counts of receiving and possessing an unregistered destructive device.
WHAT THE RECORD SHOWS
The Justice Department list records the pardon on September 3, 2026 and gives his sentencing date as June 13, 2023, with a sentence of 240 months' imprisonment and three years' supervised release. AmmoLand reported that ATF agents raided the former Navy petty officer's Virginia Beach home in April 2022 after a paid confidential informant reported a grenade launcher, that he was charged with five counts covering unregistered firearms, a machine gun transfer tied to PPSh-41 parts kits and three unregistered destructive devices, and that a jury convicted him on all five, with ten-year terms stacked consecutively on the machine gun counts to produce the twenty-year sentence.
AmmoLand reported that the Fourth Circuit found double jeopardy on two counts, vacated Count 1 and remanded for resentencing while affirming the remaining convictions, and that the Supreme Court denied certiorari in May 2026. It reported that the district judge vacated Count 1 in December 2025, later canceled a June 2026 resentencing hearing and continued the matter, and that the government asked the court to reimpose a twenty-year term; the cited sources do not say what sentence was in effect when the pardon was granted. AmmoLand also reported that several House members wrote to the Justice Department and the pardon attorney urging consideration of his case. Former U.S. Pardon Attorney Liz Oyer wrote that Adamiak's case was a focal point for gun rights activists and that his pardon was celebrated by the NRA. The Ledger ran all thirty names in this grant against FEC contribution records for the 2024 and 2026 cycles and found no contribution it could tie to a recipient.
RESPONSE
Adamiak said in a statement quoted by AmmoLand that the feeling of freedom was surreal after four years inside, thanked his family, legal team, the organizations and journalists who fought for him, and thanked President Trump for granting him “a full and unconditional pardon.” AmmoLand reported that Gun Owners of America posted on September 4, 2026 thanking the president and naming Adamiak among four gun owners pardoned over National Firearms Act convictions. White House pardon czar Alice Marie Johnson, announcing the grants in a September 4 post on X, wrote that September 3 was “a powerful day for second chances” and described the thirty as “deserving individuals” whose cases her team had reviewed.
Correction to the shared entry, September 2026 batch of 30. An earlier version said Emory Jones did not appear on the Justice Department list and described his case as a 2000 conspiracy. The list shows his pardon dated September 8, 2026, and gives October 15, 2000 as his sentencing date. Corrected September 18, 2026.
